Welcome to Capitol Area Technologys Website. This Agreement contains the complete terms and conditions that
apply when you visit our site or use, choose to browse the contents, herein. By using this Website, you
agree to be bound by its terms of use and shall comply thereof. This Agreement describes and encompasses the
entire agreement between Capitol Area Technology and you, and supersedes all prior or contemporaneous
agreements, representations, warranties and understandings with respect to the Site and the content provided
by or through the Site, and the subject matter of this Agreement.
This Agreement constitutes the entire agreement between Capitol Area Technology and you with your use of any
of the Sites. If a court finds any provision of the Agreement or any part thereof, to be unenforceable, that
provision shall be enforced to the maximum extent permissible to affect the intent of the Agreement, and the
remainder of the Agreement shall continue in full force and effect.
These terms and conditions (“Terms & Conditions”) shall apply to Capitolareatechnology.com and all other
Capitol Area Technology, LLC (“Capitol Area Technology,” “CAT,” “we,” “us,” or “our”) websites licensed to
authorized sales and service center (collectively, the “Sites”). Please read these Terms & Conditions
carefully, as your use of any of the Sites constitutes your agreement to abide by these terms.
We may, in its our sole discretion, terminate, change, suspend or discontinue any aspect of the Sites and
the availability of any features at any time. We may also impose restrictions on the use of certain features
and services or restrict your access to part or all the Sites for any reason without incurring any liability
to you.
Despite our best efforts, Capitol Area Technology is not responsible if the information made available on
the Sites is not accurate, complete or current. The Materials (images, prices, product descriptions, stock
quantities) on the Sites are provided for general information only and should not be relied upon or used as
the sole basis for making decisions without sourcing Capitol Area Technology's Customer Support
([email protected]) for more accurate,
complete, or timely information. Any reliance on the Materials on
the Sites is at your own risk. The Sites may contain certain historical information which is not current and
is provided for reference only. We reserve the right to modify the contents of the Sites at any time without
obligation on our end to update any information on the Sites. You understand and agree that it is your
responsibility to monitor changes to the site.
Each part will be defined with a Condition relating to the state of the individual part. Capitol Area
Technology's experts carefully inspect and label each part accordingly. These definitions were made by
Capitol Area Technology and are applied at our own determination.
New:
Part is genuine, factory new, in unopened original MFG packaging. These products are
New-Other:
The part is new, but not original packaging. For quality assurance purposes, some products may not have a
factory seal. This denotes that the product was inspected by our experts to ensure quality & authenticity.
Refurbished:
The part was repaired and has the appropriate paperwork signifying the refurbished/repaired while detailing
the testing done and its results.
Used:
The part is used.
The List Price displayed for products on our website represents the full retail price listed on the product
itself. The List Price is a comparative price estimate and may or may not represent the prevailing price in
every area on any given day. We do not warrant that product descriptions or other content of this site is
accurate, complete, reliable, current, or error-free. If a product offered on our website is not as
described, your sole remedy is to return it in unused and unopened condition.
If you purchase products through our Sites, by email, or an electronic data interchange or EDI system
(collectively, “e-commerce"), you agree that (i) any contract of sale resulting from an e-commerce
transaction is legally binding and enforceable, notwithstanding the provisions of any law relating to
whether agreements must be in writing or signed by the parties to be bound thereby; and (ii) copies of our
e-commerce records are admissible in any legal proceeding under the business records exception to the
hearsay rule, the best evidence rule or any other rule of evidence, notwithstanding that such records were
not originated or maintained in documentary form. In the event of a dispute, the business records maintained
by us regarding your e-commerce purchase with us shall be deemed to be the governing records for the purpose
of establishing the terms of those purchases.
Capitol Area Technology offers the following payment methods:
Except as otherwise provided on the Site or directly from Capitol Area Technology, we offer PayPal, American Express, Discover, MasterCard, Visa, and prepaid wire transfer. A $45 wire fee or 3.2% convenience fee will be applied to credit card and PayPal payments. This extra charge allows Capitol Area Technology to possess largely accessible payment methods for our customers globally.

Customer represents that any supplied credit card or similar information is true and correct and customer
has all proper rights in same, that all charges will be honored by customer's credit card company and that
it will pay all credit card fees as charged.
Customer shall also pay all applicable sales tax. Customer shall indemnify, defend and hold Capitol Area
Technology and its personnel harmless against any claims against some or all of them in relation hereto.
Consequences of late/nonpayment:
All payments are to be made prior to shipment. Any nonpayment will result in a withholding of the
shipment until payment is made.
Requirements: To request tax-exempt status in a particular state tax jurisdiction, you must provide
us with
a tax exemption certificate or other equivalent tax exemption documentation or information acceptable to the
relevant tax authority. We reserve the right to reject any request in our sole discretion. If we do not
reject your request, then subject to the terms of this Agreement, sales tax will not be charged for purchase
you make during the exempt period set forth in your tax exemption documentation or information.
Representations, Warranties and Indemnity: You represent and warrant to us that any tax documentation
or
information you provide to us is valid and accurately reflects your tax status, and that you will provide
updates as needed to ensure the documentation or information remains accurate at all times. All products and
services purchased using an account designated with tax-exempt status and shipped to enrolled state tax
jurisdictions will not be subject to sales and use tax. You agree to not use your tax-exempt account for the
purchase of products or services that are not eligible for tax-exempt status. You further agree that if you
do not use the products or services purchased with your tax-exempt account for the purpose for which your
tax exemption applies, you will report and pay sales and use taxes directly to the state relating to the
products or services to the extent required by law. To qualify for exemption, you may be required by law to
pay us using your organization’s payment method (e.g., a company credit card) and not a personal payment
method (e.g., a personal credit card). You will comply with such requirement to the extent required by law.
You agree to indemnify and hold us harmless for any and all claims relating to your breach of any
representation, warranty or obligation set forth in this Section.
The buyer is responsible for all shipping and handling costs, including any applicable insurance, taxes,
tariffs or duties.
Though it is not required, using your own shipping account is recommended. When a shipping account is not
used, Capitol Area Technology will prepay for the label and add the shipping costs to the order.
For all orders, please allow 24-48 hours for processing once payment is received.
We offer standard, upgraded and express shipping. A $100 charge is added for the same-day expedite fee.
A $ 7.95 handling fee is applied when using your own shipping account
All repairs must be sent in for a free evaluation and quote. Capitol Area Technology will then send your
item(s) back if you choose to forgo the repairs. Return shipping is the responsibility of the customer.
Though it is not required, using your own shipping account is recommended. When a shipping account is not
used, Capitol Area Technology will prepay for the shipping label and add the costs to the
order.
Warranties on repairs
will be dependent on the specific item and nature of the repair. All repair warranty information will be
disclosed and included in the return shipment of said part(s).

We give each of our customers the ability to cancel their order without any repercussions or fees if it is within 24 hours of the original order. No harm, no foul.

Any product returned opened, not with or with the original packaging altered in anyway, or otherwise in any condition different than was delivered to you, a 15% restocking fee will be deducted from the refund.
“You sent me the wrong thing...”
We have humans working in our warehouse. If mistakes were made while packaging your order let us know. Capitol Area Technology will cover the cost of return shipping and refund the cost of the part.
“My items were damaged...”
Capitol Area Technology is not responsible for items damaged during shipping or delivery. Further, Capitol Area Technology shall not be liable for any special damages including consequential damages, incidental damages, lost profits, or lost revenue. If your order arrives damaged, Capitol Area Technology recommends contacting your shipping provider.

- Returns +30 days of Original Invoice
We do not accept returns of any kind 30 days past the original invoice date.
Orders that are shipped to countries outside of the U.S. may be subject to import taxes, customs duties and
fees levied by the destination country. These charges for customs clearance must be paid by the recipient;
we have no control over these charges and cannot predict what they may be. Customs policies vary widely from
country to country. Please contact your local customs office for information.
When customs clearance payment and/or procedures are required, it can cause delays beyond our delivery
estimates. Credit Card verification may take up to 72 hours (about 3 days). Wire Transfers: Allow 3 - 5
business days for receipt of funds. Should any part of this transaction contravene TX or U.S. Export laws,
this transaction shall be immediately void and unenforceable.
24-Hours after order
We give each of our customers the ability to cancel their order without any repercussions or fees if it is
within 24 hours of the original order. No harm, no foul.

Any working items returned, Buyer is responsible for return shipping OR Capitol Area Technology will prepay
for the shipping label and deduct the costs from the return. Only the cost of the part will be refunded. Any
product returned opened, not with or with the original packaging altered in any way, or otherwise in any
condition different than was delivered to you, a 15% restocking fee will be deducted from the refund as
well.
“You sent me the wrong thing...”

Capitol Area Technology will cover the cost of return shipping and refund the cost of the part upon
verification of the mistake.

This agreement is governed by & construed in accordance with the laws of Austin, TX. US 78737. Any dispute,
controversy or difference which may arise between the parties out of, in relation to or in connection with
this Agreement is hereby irrevocably submitted to the exclusive jurisdiction of the courts of Texas, to the
exclusion of any other courts without giving effect to its conflict of laws, provisions, or your actual
state or country of residence.
Capitol Area Technology retains all rights regarding its trademarks, trade names, brand names and trade
dress, including the name “Capitol Area Technology,” the Capitol Area Technology logo and/or any other
Capitol Area Technology product or brand names referenced on the Sites. These trademarks, trade names, brand
names, trade dress, and all associated logos or images, are registered and/or common law trademarks of
Capitol Area Technology and are protected by U.S. and international laws and treaties. No license to use
such images, names or trade dress is granted to you under these Terms and Conditions or by your use of the
Sites. Your misuse of the trademarks, trade names, brand names and/or trade dress displayed on the Sites is
strictly prohibited.
All content on the Sites, including, without limitation, the text, design, graphics, logos, icons, images,
audio clips, downloads, interfaces, code & software, as well as the selection and arrangement thereof (the
“Materials”), is the exclusive property of Capitol Area Technology or its content providers and is protected
by copyright, trademark and other applicable laws. Capitol Area Technology does not grant any express or
implied right to you regarding any patents, treaties, copyrights, trademarks, trade names, brand names,
trade dress or trade secret information owned by Capitol Area Technology. You may access, copy, download and
print the Materials contained on the Sites solely for your personal and noncommercial use, provided you do
not modify or delete any copyright, trademark or other proprietary notice that appears on the Materials. The
Materials are provided to you under a non-exclusive, limited license that is revocable at any time in
Capitol Area Technology’s sole discretion. Any other use of the Materials, including but not limited to the
modification, distribution, transmission, performance, broadcast, publication, uploading, licensing,
translating, reverse engineering, transfer of sale of, or the creation of derivative works from, is
expressly prohibited.
Capitol Area Technology retains full and complete title to the Materials, including all associated
intellectual property rights, and provide the Materials to you under a limited license that is revocable at
any time in Capitol Area Technology’s sole discretion. You agree to abide by all additional restrictions
displayed on the site as it may be updated from time to time. Capitol Area Technology reserves the right to
refuse or cancel any person’s registration for the Sites, remove any person from the Sites, or prohibit any
person from using the Sites for any reason whatsoever.
You may not use contact information provided on the Sites for unauthorized purposes. You may not use any
hardware or software intended to damage or interfere with the proper working of the Sites or to
surreptitiously intercept any system, data or personal information from the Sites. You agree not to
interrupt or attempt to interrupt the operation of the Sites in any way. Capitol Area Technology reserves
the right, in its sole discretion, to limit or terminate your access to or use of the Sites at any time
without notice. Termination of your access or use will not waive or affect any other right or relief to
which Capitol Area Technology may be entitled at law or in equity.
You acknowledge and agree that you assume full responsibility for your use of the Sites. You acknowledge and
agree that, despite Capitol Area Technology’s best efforts to protect user’s sensitive information, any
information you send or receive during your use of the Sites may not be secure and may be intercepted by
unauthorized parties. You acknowledge and agree that your use of the Sites is at your own risk and that the
Sites are made available to you at no charge. Recognizing such, you acknowledge and agree that, to the
fullest extent permitted by applicable law, Capitol Area Technology will not be liable for any direct,
indirect, punitive, exemplary, incidental, special, consequential or other damages (including, without
limitation, any lost profits, business interruption, loss of information or programs or other damages to
your information handling system(s)) arising out of or in any way related to the Sites, or any other site
you access through a link from the Sites or from any actions we take or fail to take as a result of
communications you send to us, or the delay or inability to use the Sites, for any information, products or
services advertised in or obtained through the Sites or deletion of any Materials submitted or posted on the
Sites or otherwise arising out of the use of the Sites, whether based on contract, tort, strict liability or
otherwise, even if Capitol Area Technology has been advised of the possibility of damages. This disclaimer
applies, without limitation, to any damages or injury arising from any failure of performance, error,
omission, interruption, deletion, defects, delay in operation or transmission, computer viruses, file
corruption, communication-line failure, network or system outage, your loss of profits, or theft,
destruction, unauthorized access to, alteration of, loss or use of any record or data, and any other
tangible or intangible loss. You specifically acknowledge and agree that Capitol Area Technology shall not
be liable for any defamatory, offensive or illegal conduct of any user of the site. Your sole and exclusive
remedy for any of the above claims or any dispute with Capitol Area Technology is to discontinue your use of
the Sites.
At certain places in the Sites, links to other websites may be provided. These links are provided as a
convenience only. Capitol Area Technology does not endorse, approve, guarantee, or control these linked
websites in any manner, and is not responsible for the content of any linked website. Different terms and
conditions may apply to your use of any linked sites. Capitol Area Technology is not responsible for any
losses, damages or other liabilities as a result of your use of any linked sites. It is your duty to review
the terms, conditions and policies of any such external website before use.
Capitol Area Technology reserves the right, at its sole discretion, to change, modify, add or remove any
portion of the Terms and Conditions in whole or in part, at any time. Changes in this Agreement are
effective when notice of such change is posted on capitolareatechnology.com. It is your responsibility to
check periodically for any changes we make to the Terms of Use.
